Welcome to Mktezy.com, India's premier online content selling platform where creators from across the country upload and sell their non digital and digitial products including ebooks, online courses, templates, and audio content directly to eager buyers. Operating from Bangalore, Karnataka, these Terms and Conditions govern your access to and use of our platform, the transactions that occur between creators and buyers, and the services we provide as a technology intermediary facilitating content discovery, secure payments, and instant digital delivery. By registering an account, browsing content, making purchases, or uploading products for sale, you enter into a legally binding agreement with 4uSofts Infomedia Private Limited, a private limited company incorporated under the laws of India with its registered office located in Bangalore.

Mktezy serves as a neutral technology platform connecting content creators with buyers, much like a digital selling platform where independent sellers showcase their work. We provide the infrastructure for creators to upload their digital files, create shareable product pages, URL, process payments through secure gateways and deliver content via secure links that protect intellectual property. Importantly, Mktezy.com does not create, own, endorse, or guarantee the quality, accuracy, or suitability of any content uploaded by creators. All sales transactions occur directly between the individual creator and the purchasing buyer, with Mktezy.com earning only a commission on each successful sale while creators retain most of their earnings paid out based on mutual agreement between Mktezy and the content creator

To use our platform, you must be at least 18 years of age or the age of majority in your jurisdiction, legally competent to enter contracts under Indian law, and not prohibited from using digital services by any applicable regulations. Minors under 18 may access the platform only with explicit parental or guardian consent and supervision. Creators must verify ownership of all uploaded content and represent that they hold necessary rights, licenses, and permissions to commercially distribute their products. Buyers agree to use purchased content only for personal, non-commercial purposes and not to redistribute, resell the content with others.

Mktezy operates as an intermediary under Section 79 of the Information Technology Act, 2000 and complies with the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021. This means we do not pre-screen, monitor, or verify creator content before it goes live, nor do we participate in pricing negotiations, quality assurance, or post-sale quality disputes. Creators are solely responsible for the accuracy of their product and service descriptions, the functionality of their digital files, and honoring any refund or support commitments made to buyers. While we employ automated malware scanning and implement robust security measures including 256-bit SSL encryption and prepared database statements, we cannot warrant that all content meets professional standards or fulfills buyer expectations.

Users of the platform agree not to upload or distribute illegal content, pirated materials, malware, adult content, or anything violating Indian copyright laws, the Information Technology Act, or other applicable regulations. Prohibited activities include spam, scams, harassment, reverse engineering our platform, or attempting to circumvent security features like expiring download links. Violations result in immediate account suspension, content removal, and potential legal action with relevant authorities notified as required by law. Intellectual property owners can report DMCA violations to support@mktezy.com for processing within 24 hours per IT Rules 2021 requirements.

Payments are processed securely through industry-standard gateways with full PCI-DSS compliance. Upon successful payment Instant Payment Notification will be issued, buyers receive automated email delivery information. Creators access real-time dashboards showing sales analytics, earnings calculations, and payout histories. All transactions include GST invoicing as mandated by Indian tax laws, with creators responsible for their invoicing and income tax filings and buyers eligible for input tax credit where applicable. for buyers, Mktezy.com don't entertain or respond to any GST related enquiries which comes under creators responsiblity. However creators will get access to tax invoice from Mktezy.com for the deducted commission on sale.

Mktezy.com provides creators with powerful shareable content pages optimized for WhatsApp forwarding, Instagram stories, and LinkedIn posts, each generating trackable analytics on views, conversion rates, and geographic distribution. These mini-storefronts feature creator branding, customer testimonials, preview samples, and one-click checkout buttons, driving organic growth without paid advertising. The platform's mobile-responsive design ensures seamless experience across phones, tablets, and desktops, reflecting India's mobile-first digital consumption patterns.

Our liability is strictly limited to fees paid (if any) and excludes indirect, consequential, or punitive damages. The platform operates "AS IS" without warranties regarding content quality, availability, or uninterrupted service. Force majeure events including technical failures, cyberattacks, regulatory changes, or natural disasters exempt us from performance obligations. Bangalore courts hold exclusive jurisdiction over disputes, with arbitration available through a single arbitrator in Bangalore per Indian Arbitration Act.

Creators agree to maintain accurate GST records, comply with RBI payment guidelines, and handle customer support including refunds when their policies permit. Buyers acknowledge that product links may expire for security and must contact the specific creator for support, re-delivery requests, or disputes. Mktezy.com facilitates communication but cannot mediate content or service related disagreements.

We reserve the right to modify these Terms with (or) without notice posted on the platform, where continued use constitutes acceptance. Account termination can occur immediately for legal violations or at our discretion for platform abuse. Upon termination, creators receive final payouts for completed sales minus any chargebacks or disputes.

For legal notices, serve at our Bangalore address registered with the Ministry of Corporate Affairs. These Terms represent the complete agreement superseding prior understandings, governed exclusively by Indian law.

By accepting these Terms and Conditions, you expressly consent and agree that Mktezy.com and its assoicated businesses may contact you through all available communication channels including but not limited to SMS, voice calls, WhatsApp messages, email, push notifications, and any other electronic or telephonic means for purposes such as transactional, promotional offers, customer support, legal notices, and marketing communications. You acknowledge that these communications may originate from auto-dialed systems, pre-recorded messages, or artificial intelligence, and you waive any rights to claim DND (Do Not Disturb) registry violations under TRAI regulations or similar preferences expressed elsewhere. This consent remains effective until you formally opt-out by emailing support@mktezy.com with "STOP ALL COMMUNICATIONS" subject line, though certain transactional messages required by law (order confirmations, payment receipts) will continue.
